Terms of Use

These Terms of Use (“Terms”) govern your use of Noise Diary (the “App”). By downloading, installing, purchasing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

Important measurement notice: Noise Diary provides approximate sound-level estimates calculated from an iPhone microphone. It is not an IEC-compliant professional sound level meter. Do not use the App or its exports for legal evidence, health or hearing-safety decisions, workplace compliance, regulatory reporting, or any situation that requires a certified instrument or professional assessment.

1. What the App Does

Noise Diary provides tools to:

• display an approximate live dB(A) value;
• start and stop a user-initiated noise event;
• calculate and save approximate Leq, maximum, and minimum values;
• add tags and notes and review local measurement history;
• apply a local calibration offset using a reference meter;
• export selected records or history as CSV or PDF;
• continue only an event you started while the screen is locked or another app is open, subject to iOS operation and interruption.

The App does not continuously monitor the environment outside an event you start and does not create or store an audio recording.

2. License and Apple Terms

The App is licensed, not sold. Subject to these Terms and Apple’s applicable usage rules, the developer grants you a limited, non-exclusive, non-transferable, and non-sublicensable license to use the App for personal and lawful purposes on Apple-branded devices you own or control.

Your use of the App is also subject to Apple’s Standard Licensed Application End User License Agreement and applicable Apple Media Services terms. If these Terms conflict with a mandatory Apple term or applicable law, the mandatory term or law controls.

3. Measurement Limitations

3.1 Approximate Values

Readings depend on the iPhone model, microphone condition, protective case, microphone position, selected audio input, frequency content, environment, operating-system behavior, and calibration settings. Error may increase for low-frequency, impulsive, clipped, obstructed, or very loud sounds.

3.2 Calibration

The calibration offset is a convenience feature for comparing the App with a trusted reference meter under similar conditions. It does not certify the App, the device, or any reading. A calibration made for one device, case, microphone, or input route may not be suitable for another.

3.3 No Accuracy Certification

The developer does not represent that Noise Diary meets IEC 61672 or another professional sound-level-meter standard. No statement in the App, its documentation, or an export should be interpreted as a guarantee of accuracy, admissibility, safety, compliance, or fitness for a regulated purpose.

4. Your Responsibilities

You are responsible for:

• deciding whether an approximate measurement is suitable for your personal use;
• using a certified instrument and qualified professional when accuracy or compliance matters;
• reviewing event times, values, tags, notes, calibration settings, and exports before relying on or sharing them;
• keeping suitable backups of records you consider important;
• obtaining any consent required before measuring, describing, or sharing information about other people or private places;
• using background measurement only for an event you intentionally started and complying with local law.

5. Prohibited Uses

You may not:

• use the App in violation of law or the rights of another person;
• misrepresent approximate readings as certified, professionally calibrated, or legally conclusive;
• use the App as the sole basis for medical, hearing-safety, workplace, tenancy, regulatory, or emergency decisions;
• fabricate, alter, or present records for fraud, harassment, deception, or unlawful surveillance;
• interfere with the App’s operation or security;
• copy, modify, reverse engineer, decompile, or redistribute the App except to the extent expressly permitted by applicable law or applicable open-source licenses.

6. Free Features and Lifetime Pro

6.1 Free Use

The App may allow you to measure sound, create noise events, and keep a limited number of saved events without purchasing Pro. The current limits and available features are shown in the App.

6.2 Lifetime Pro

Noise Diary may offer a non-consumable, one-time in-app purchase called Lifetime Pro. It is not an auto-renewing subscription and does not create recurring charges. Lifetime Pro may unlock unlimited history, full-history batch CSV export, PDF reports, and other features identified on the purchase screen.

6.3 Payment and Restoration

Apple processes purchases, billing, transaction verification, and entitlement restoration through the App Store and StoreKit. The price and applicable tax shown on Apple’s purchase confirmation screen control. You may use Restore Purchases to ask Apple to restore an eligible purchase associated with the same Apple Account.

6.4 Refunds and Future Features

Apple determines refund eligibility and processes approved refunds under its policies. A Lifetime Pro purchase unlocks the eligible features provided by this App for the supported lifetime of this App. It does not guarantee every future feature, a separate app, an external service, perpetual compatibility with future hardware or operating systems, or continued availability where providing the App becomes unlawful or impracticable.

7. Data, Exports, and Privacy

Microphone analysis and saved measurement records are handled on your device. The App does not create an audio recording or send raw audio to the developer. If you export or share a CSV, PDF, tag, note, or other content, the copy is handled by the destination you choose. For more information, read the Noise Diary Privacy Policy.

8. Background Operation and Interruptions

An event you deliberately start may continue while the App is in the background or the screen is locked. Background operation can be interrupted or stopped by iOS, a call, an alarm, another audio session, an audio-route change, low resources, device restart, force quit, permission changes, or other system conditions. The App does not guarantee uninterrupted measurement or complete recovery of every active event.

9. Intellectual Property

The App, its software, design, text, graphics, trademarks, and other components are owned by the developer or their respective rights holders. These Terms do not transfer ownership of your tags, notes, measurement records, or exported files to the developer.

10. Updates, Changes, and Discontinuation

The developer may update, modify, limit, suspend, or discontinue all or part of the App for security, quality, compatibility, legal, technical, or business reasons. Device, iOS, App Store, or third-party-service changes may affect availability or operation. The developer does not guarantee permanent compatibility with every current or future device or operating-system version.

11. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the App is provided “as is” and “as available,” with all faults and without warranties of any kind. The developer does not warrant that the App will be uninterrupted, error-free, completely secure, free from data loss, or suitable for a particular purpose, or that any reading, aggregate, calibration, background session, recovery, or export will be complete or accurate.

Some jurisdictions do not allow certain warranty exclusions, so some of the exclusions above may not apply to you.

12. Limitation of Liability

To the extent permitted by applicable law, the developer will not be liable for indirect, incidental, special, consequential, or exemplary damages, loss of data, loss of opportunity, business interruption, or decisions made from an approximate reading, missed event, interrupted session, calibration difference, or export. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including mandatory consumer rights.

13. Third-Party Services

Apple services, email, websites, backup services, and destinations selected from the iOS share sheet are operated by third parties under their own terms and privacy policies. The developer is not responsible for the availability, content, security, or practices of a third-party service.

14. Termination

These Terms remain effective until terminated by you or the developer. You may stop using and delete the App at any time. Your license terminates automatically if you materially violate these Terms. Provisions that by their nature should survive termination—including intellectual property, warranty disclaimers, liability limitations, and applicable-law provisions—will survive.

15. Changes to These Terms

These Terms may be updated when the App’s features, purchase terms, technology, or legal obligations change. Material changes will be identified on this page or in the App where appropriate. Continued use after updated Terms take effect constitutes acceptance to the extent permitted by applicable law.

16. Governing Law and Severability

These Terms are governed by applicable law without limiting any mandatory consumer protections in your country or region. If a provision is found invalid or unenforceable, the remaining provisions remain in effect.
